The last invoice is the leverage

Why the Final Payment Is the Deadline

Your contractor has finished, the last invoice has landed, and something does not feel right. That invoice is the moment worth pausing on.
Once the final payment clears you still have your contractual and legal claims. What you lose is the one piece of leverage that costs you nothing to use. Money in your account is a conversation. Money in his account is a dispute.
Worth being straight about the payment structure. Retention is standard in UAE construction contracts, typically 10 percent released half on completion and half after the defects liability period. It is not legally mandated, and it is not standard in homeowner renovation contracts. If you did not negotiate it in writing you do not have any, and the final balance is all the leverage there is.

Two other clocks are running

Your developer or Owners Association refundable security deposit, usually AED 2,000 to 20,000, is released only after final inspection and as-built submission, and any contractual defects liability period runs from completion.

The message we get most often reads like this. The work finished last week, the contractor has sent the final invoice, and something about the second bathroom does not feel right, but there is nothing to point at. That is a one-day job for us, and the last week in which pointing at it costs you nothing.
Stage inspection

The Inspection That Has to Happen Before Tiling

If your wet areas are not tiled yet, book this one instead. It is the most valuable inspection on a renovation, and nobody else sells it.

What gets buried, and when

The expensive failures are not the ones you can see. They are the ones the next trade covers up: the waterproofing membrane, the screed, the MEP first fix, the duct runs above the ceiling.

Best practice is a 48-hour flood test on the membrane before any tiling starts, and PPR supply lines pressure-tested at 10 bar for 24 hours. Most homeowners never find out whether either happened, because by the time anyone asks the evidence is under a floor.

The economics make it urgent. A membrane plus testing costs around AED 2,000 to 5,000 per bathroom. In a real published Dubai Marina bathroom project totalling AED 70,700, the tiling and marine joinery on top came to AED 34,500. Reaching a AED 3,000 component afterwards means destroying the AED 34,500 first.

One shortcut worth naming: tiling directly over existing tiles seals ageing plumbing and failing waterproofing underneath, where nobody finds it until the ceiling below starts staining.

Done, and done right

What a Renovation Inspection Covers

The question changes with the job. On a new build it is “does this match the specification”. On a renovation it is “was it done, and done right, now that most of it is hidden”.

Wet areas and waterproofing

Membrane condition where still visible, falls and drainage slope after a wet area was relocated, thermal and moisture survey of walls and floors, silicone and grout sealing, threshold levels, and the ceiling below.

MEP: electrical, plumbing and AC

Distribution board changes and added circuits, RCD protection, circuit loading against the new kitchen and AC demand, water pressure after pipework alterations, chilled water pipe insulation, fan coil access, duct condition and airflow balance.

Finishes, tiling and joinery

Tile lippage and hollow tiles over new screed, gypsum cracking at joints, paint film and plaster consistency, joinery alignment, drawer runners and hinges, and whether the false ceiling has access panels where the services above it will need reaching.

Compliance and safety

Unsealed service penetrations, relocated sprinkler heads and smoke detectors in high-rise apartments, and visible signs the work went beyond what was permitted.

We use thermal imaging, moisture meters, non-destructive testing and, on villas and roofs, drone survey. Thermal imaging finds moisture behind a finish before it stains it, a moisture meter confirms it, and neither requires opening anything up.

What Actually Goes Wrong on a Dubai Renovation

AED 60,000 and up

Wet-area waterproofing

The costliest thing that goes wrong. Waterproofing failure at roof terraces and villas ranks as the most expensive defect category in Dubai property at AED 60,000 and up, with a hidden bathroom wall leak at AED 25,000 and up behind it.

In an apartment there is a third party. Failed wet-area waterproofing is among the leading causes of ceiling damp in Dubai apartments, and when it is your bathroom above someone else’s ceiling, the downstairs owner and the Owners Association have a claim against you, not your contractor.

Pattern, not presence

Hollow tiles and lippage from new screed

Tiles laid with dab-and-dot adhesive, or onto screed that had not cured, sound hollow underfoot. Not every void is a defect. Isolated hollowness can be acceptable, but a repeating pattern at the corners, voids across half a tile, or any hollowness in a wet area points to bedding failure. Load added, never calculated

Electrical circuits and distribution boards

Renovations add load. A new kitchen, a bigger AC, more lighting, smart-home wiring. Circuits get added and boards changed, often with no load calculation behind it. Older Dubai villa stock frequently lacks adequate RCD protection to begin with, and undersized circuits do not announce themselves until something starts tripping on a hot evening.

Almost nobody checks it

AC ducts, diffusers and airflow balance

The one almost nobody checks. When a ceiling is rebuilt, ducts and diffusers get moved, which changes airflow distribution across the whole system. The system needs rebalancing afterwards and rarely gets it. The symptom is a room that will not cool after a renovation that never touched the AC unit.

Coverage was designed around it

Fire stopping, sprinklers and detectors in high-rise apartments

New pipework and cabling create penetrations through fire-rated construction, and those need fire stopping. Relocating a sprinkler head or smoke detector changes the coverage the system was designed around.

Whether Dubai Civil Defence formally requires a certificate for private residential work is disputed and varies by building and scope. Set that aside. If your renovation moved sprinklers, detectors or fire-rated ceilings in a tower, the fire system was altered, and that is worth verifying whatever paperwork was required.

It does not leak, it harvests

Chilled water pipe insulation

A chilled water pipe stripped of its insulation during a ceiling rebuild does not leak. It harvests water out of the air, continuously, all summer, and drips it onto whatever is below. We covered this case here: damp on an apartment ceiling.

Was Your Renovation Actually Permitted?

Most owners assume their contractor handled it. Some did.

What needs a permit in Dubai

The approval stack has layers.
  • Apartments need an Owners Association or building FM NOC first.
  • Villas and townhouses in Emaar, Nakheel, Damac or Meraas communities need a master developer NOC.
  • Then the permit itself: Dubai Municipality through the Building Permit System for most of Dubai, Trakhees for Palm Jumeirah, JAFZA and Dubai South, and the Dubai Development Authority for its free zones.
  • DEWA approval applies separately to load increases and added circuits.
After completion, DM and DEWA inspect and a Property Completion Certificate is issued alongside DEWA clearance. Ask your contractor for it. Most owners have never heard of it, which is exactly why it is worth asking.
Permit territory covers structural changes, wall removal or new partitions, MEP relocations, wet area moves, AC duct changes, facade alterations, balcony enclosure and villa extensions. Painting, flooring and fixture swaps generally do not, though flooring is community-dependent in apartments where it affects acoustic layers.

The rule worth remembering: if the work touched a wall, a ceiling slab, an electrical circuit, a plumbing line or the air conditioning, assume a permit was needed.

Only licensed, DM-approved contractors can apply for one, and Emaar maintains an approved contractor database that gate security checks. So the test is simple. If your contractor was not on the approved list, no permit was pulled, whatever you were told.

What happens if it was not permitted

Local Order No. 3 of 1999

Articles 26 and 28

Local Order No. 3 of 1999 governs, and it is specific. Article 28 provides fines of not more than AED 50,000, doubled for repeat violations, alongside utility disconnection and possible revocation of the contractor’s licence. Article 26 lets the authority order illegal works demolished and removed, carry that out directly, and recover the cost from the violator plus 20 percent in administrative fees.

Note where that lands. You are the owner and the permit holder, so enforcement reaches you first, and chasing the contractor afterwards is a separate job you fund yourself. That is the argument for inspecting while he still needs something from you.

At resale it is less dramatic than people claim. Unpermitted work does not block a DLD transfer, it stalls one. The developer NOC is a mandatory gate, so the real cost is delay, a demand to regularise, and a forfeited deposit.

One honest boundary. We inspect and document the physical work and flag anything that looks unpermitted. Permit and NOC records sit with the developer and Dubai Municipality, so we tell you exactly which approvals to request and what the paperwork should show.

Three things, one stronger than you think

What You Can Actually Do About It

Three things, and one is stronger than most people realise.

The warranty you have is the one in your contract

No UAE law mandates a workmanship warranty on a residential renovation. Twelve months is common where a defects liability period exists at all. If your contract is silent, so is your warranty.

Articles 821 to 824, Federal Decree-Law No. 25 of 2025

Decennial liability probably will not help

It is a real ten-year regime under Articles 821 to 824 of Federal Decree-Law No. 25 of 2025, and Article 823 voids any attempt to contract out of it. But it targets collapse and defects threatening the safety, solidity or structural integrity of a building. A failed shower membrane, hollow tiles and an unbalanced AC system sit outside it. A structural villa extension designed by an engineer is the edge case, and even that is untested.

Article 818(2), Federal Decree-Law No. 25 of 2025

The remedy that does help is Article 818(2) of the same law

You can demand corrective work within a reasonable timeframe, and if the contractor fails, you may rescind or engage a replacement at his expense, without court approval. You generally have to place him formally in default first, and a dated, photographed report is the evidence that makes that stand up.

If it escalates

The ladder runs: formal legal notice, a Dubai Municipality complaint against a licensed contractor, a consumer complaint via the Ministry of Economy on 800 1222 or Dubai DET at consumerrights.gov.ae, then Dubai Courts. One point most people get wrong: file before hiring a replacement, so the original defects are still there to be evidenced.

Scope and document review

Send us the contract, the scope of works, the bill of quantities and any drawings. We inspect against what you were quoted and what was drawn, not against opinion. This is what turns “he says it is normal” into a checkable question.

On-site inspection by a certified engineer

Your engineer works the property room by room, photographs every defect in place with a location reference, and takes thermal and moisture readings across the wet areas and any wall bordering one.

You get the report within 24 hours of the visit. Every item carries a photograph, a location, a severity rating and a rectification note, written in the language a contractor’s foreman will act on.

The number that matters is the ratio

The number that matters is the ratio, not the fee. A bathroom renovation in Dubai runs AED 30,000 to 55,000, a two-bedroom apartment AED 100,000 to 180,000, a villa AED 300,000 to 800,000. Against those, the inspection is under two percent on a bathroom and well under one percent on a villa. Set it against a waterproofing rectification starting at AED 25,000 and the arithmetic stops being close.

How much does a renovation inspection cost in Dubai?

Pricing starts from AED 799 and depends on scope, from a single bathroom to a full villa. Against the project: a bathroom renovation runs AED 30,000 to 55,000 and a villa AED 300,000 upward, so the inspection lands under two percent of most jobs.

When should I book a renovation inspection?

Before you release the final payment. If your wet areas are not tiled yet, book earlier: a pre-tiling inspection catches the waterproofing while it is still visible. Once the tiles are down, confirming that the membrane was done properly means taking them back up again.

Can I withhold the final payment until the defects are fixed?

Withholding is a contractual remedy, not an automatic right. It works cleanly if your contract carries a retention or milestone clause. Without one, your position rests on the contractor not having completed the agreed scope, and a dated report makes that argument defensible.

What if my contractor refuses to fix the defects?

Serve formal written notice placing him in default with a reasonable deadline. Under Article 818(2) of Federal Decree-Law No. 25 of 2025 you can then engage a replacement at his expense, without court approval. Beyond that: a Dubai Municipality complaint or Dubai Courts.
